1. Acceptance of Terms
By accessing or using the ZendZap platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. Your continued use of the Service following any updates to these Terms constitutes acceptance of those changes.
2. Service Description
ZendZap is an online platform that connects individuals who need to send packages ("Senders") with travelers who have spare luggage space ("Travelers"). The platform facilitates the coordination between Senders and Travelers, including communication, scheduling, and payment processing. ZendZap does not itself transport, ship, or deliver any packages.
3. User Responsibilities
3.1 All Users
- Provide accurate and truthful information during registration and use of the Service.
- Maintain the security of your account credentials.
- Comply with all applicable local, national, and international laws and regulations.
- Communicate respectfully and honestly with other users.
- Be at least 18 years of age to use the Service.
3.2 Senders
- Accurately describe the contents, weight, and dimensions of all packages.
- Ensure packages do not contain prohibited items (see Section 4).
- Package items securely and appropriately for travel.
- Be available for the agreed-upon handoff time and location.
- Comply with customs declarations and import/export regulations.
3.3 Travelers
- Only accept packages you are able and willing to transport.
- Handle accepted packages with reasonable care.
- Deliver packages to the agreed-upon recipient at the destination.
- Communicate promptly about any delays or issues.
- Comply with airline baggage policies and customs regulations.
4. Prohibited Items
The following items are strictly prohibited from being sent through the ZendZap platform:
- Dangerous goods, explosives, or flammable materials
- Illegal drugs, narcotics, or controlled substances
- Weapons, firearms, ammunition, or weapon components
- Hazardous chemicals or biological materials
- Counterfeit goods or items that infringe intellectual property rights
- Stolen property
- Live animals or perishable biological specimens
- Items prohibited by airline regulations or customs laws
- Any item whose transport violates local, national, or international law
Violation of this policy will result in immediate account termination and may be reported to law enforcement authorities.
5. Liability Limitations
ZendZap acts solely as a facilitator connecting Senders with Travelers. ZendZap is not a carrier, courier, or shipping company. As such:
- ZendZap is not responsible for the loss, damage, delay, or non-delivery of any package.
- ZendZap does not guarantee the availability of Travelers on any route or date.
- ZendZap is not liable for any actions, omissions, or conduct of users.
- Users agree to resolve disputes between themselves, with ZendZap providing mediation support where possible.
- In no event shall ZendZap's total liability exceed the platform fees paid by the user in the preceding 12 months.
6. Payment Terms
Fees for package transport are agreed upon between Senders and Travelers, typically ranging from $100 to $500 depending on package size, weight, and route. ZendZap charges a platform service fee on each transaction to cover operational costs and payment processing.
- Payments are processed securely through our third-party payment processor.
- Funds are held in escrow until successful delivery is confirmed by both parties.
- Travelers receive payment after the Sender confirms delivery.
- Refunds are available if a Traveler cancels before the handoff date.
- Disputes regarding payment will be reviewed by ZendZap on a case-by-case basis.
7. Package Handoff and Confirmation
The package handoff process is a critical part of the ZendZap experience:
- Senders and Travelers must agree on a handoff location, date, and time through the platform.
- Both parties must confirm the handoff through the app when the package is exchanged.
- The Sender must confirm receipt at the destination to release payment to the Traveler.
- If either party fails to appear at the agreed handoff, the other party should report it through the platform.
- Photographic confirmation of package condition at handoff is recommended.
8. Account Termination
ZendZap reserves the right to suspend or terminate any user account at its discretion, including but not limited to cases of: violation of these Terms, fraudulent activity, sending or transporting prohibited items, abusive behavior toward other users, or failure to complete agreed-upon transactions. Users may also delete their own accounts at any time through the platform settings.
9. Dispute Resolution
Any disputes arising from the use of the Service shall first be addressed through ZendZap's internal dispute resolution process. If a resolution cannot be reached, disputes shall be settled through binding arbitration in accordance with the rules of the American Arbitration Association. Class action lawsuits and class-wide arbitrations are not permitted. Users retain the right to bring claims in small claims court where applicable.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of law provisions. Any legal proceedings shall be conducted in the state or federal courts located in Delaware.
11. Changes to Terms
ZendZap reserves the right to modify these Terms at any time. Users will be notified of material changes via email or through the platform. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
